Article 3 - Applicability
These terms and conditions apply to all offers by the entrepreneur and to all distance contracts and orders concluded between the entrepreneur and the consumer. Before the conclusion of the distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract where the terms can be consulted electronically and that they will be sent free of charge upon request. If specific conditions apply to certain products or services, the provisions in the second and third paragraphs apply mutatis mutandis, and in case of conflict, the consumer may invoke the most favorable provision. If one or more provisions of these terms are null or void, the other provisions remain valid. Any null or void provision will be replaced by an equivalent provision. Situations not covered by these terms will be interpreted in the spirit of these terms and conditions. Any ambiguities will be interpreted in the spirit of these terms.
Article 4 - The Offer
Any offer with a limited validity or subject to conditions will be explicitly stated. Offers are non-binding. The entrepreneur reserves the right to modify or withdraw an offer. The offer includes a complete and accurate description of the products and/or services offered. The descriptions enable the consumer to assess the offer properly. If images are used, they faithfully represent the products offered. Obvious errors in the offer do not bind the entrepreneur.
Article 5 - Conclusion of the Contract
A contract is concluded when the consumer accepts the offer and meets the associated conditions. If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt of this acceptance electronically. Until this acceptance is confirmed, the consumer can terminate the contract. By confirming the order, you fully accept these terms and conditions and acknowledge having reviewed them on the website and checkout page.
Article 6 - Right of Withdrawal
When purchasing products, the consumer may terminate the contract without giving a reason within 14 days. This period starts the day after the consumer or a third party designated by them receives the product. During this period, the consumer must handle the product and packaging carefully. They can only unpack or use the product as necessary to determine whether they wish to keep it. If the consumer wishes to exercise the right of withdrawal, they must return the product with all accessories and, if possible, in its original condition and packaging, following reasonable and clear instructions provided by the entrepreneur. Notification of the intention to exercise the right of withdrawal must occur within 14 days of receipt, with a further 14 days to return the product.
Article 7 - Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the return shipping costs are their responsibility. If payment has already been made, the entrepreneur will refund the amount as soon as possible, but no later than 14 days after receiving the return or proof of its shipment.
Article 8 - Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for:
- Products made to consumer specifications.
- Products clearly of a personal nature.
- Products that cannot be returned due to their nature.
- Perishable or quickly expiring products.
- Products subject to market fluctuations beyond the entrepreneur's control.
- Single newspapers, periodicals, or magazines.
- Audio, video, or software with a broken seal.
- Hygiene products with a broken seal.
Article 9 - Prices
The prices of products and/or services will not increase during the validity period of the offer.
Article 10 - Delivery
Products will be delivered to the address provided by the consumer. In case of delay, the consumer will be informed within 30 days of the order.
Article 11 - Complaints
Complaints must be reported within 7 days of discovery. The entrepreneur will respond within 14 days of receiving the complaint.
Article 12 - Disputes
Contracts between the entrepreneur and the consumer are governed by Dutch law.
